about the agenda focusing on trade and commerce suddenly being overshadowed by beijing's frank comments. >> it has been a strange day. as you said, it started off with backslapping over the growth of the china-eu trade arrangement over the last 10 years. bilateral trade levels have quadrupled. there was praise from the e use side for china and praise from china for the east side, but then, as has already been made clear, suddenly, the chinese decided to get a bit negative and the live transmission was turned off. diplomatically, the eu said he was getting into the substance of the negotiation, but it was the chinese who insisted on that happening. there is a sense that the summit has been sort of run by the chinese. there was not even a final press conference because the chinese wanted a list of which journalists would be there. the european commission had to say that was just not on. there was no press conference of any sort. smiles and backslapping on trade and the economy, and yet, this underlying sense that the chinese are dictating the way the meeting is going on, and, of course, t

affect the interstate commerce coming and for period of time, they even argued that this would cover all such land that could be the habitat for migratory birds. something that is commonly referred to as the goose test. what is interesting about the regulations that the epa enforced is that we know they cannot be enforced as written. the regulation as it is promulgated purport to reach what could affect the interstate commerce. we know in the united states versus lopez in 1995 the court decision since the commerce clause doesn't reach the mere potential on the commerce. there must be a substantial effect on the interstate commerce. the existing regulations don't require the substantial effect in fact they don't even require the actual effect. by their terms they only require a potential effect. they reach far beyond the scope of the federal commerce clause authority. the supreme court has twice been asked to consider the application of the regulations to the private land owners once in the case called swank. they did it merely to keep it in the constitutional bounds and in each case they

the commerce department and what it showed was that the median price of a newly constructed home is at $257,000. that's a jump up 11% from july to august. now, a few reasons for these higher prices. less of a supply of homes on the market and that means more people are going after fewer properties. plus, mortgage rates are at record lows. that's a real good incentive to get people out there to buy. also, an increasing number of buyers. they just haven't been able to find previously owned homes that they like, they are opting to go brand-new and those are traditionally more expensive. victor? >> good news for the housing market. what impact did this have on the overall economic outlook? >> no doubt about it. housing is really a critical component and manufacturing is what pulled us out of the recession and economists, they want to see them pass the baton. that's really important for consumer spending because when people feel like their home is worth more, they feel wealthier and they tend to spend more and that's something our economy needs. a direct correlation with the job's market. people
